Image/video usage
Copyright & Reproduction Fee
Copyright to the commissioned photography remains the property of the photographer in accordance with the 1983 Copyright and Patent act. A credit must always be attributed to Rohan Strathie
All third parties (e.g. consultants, contractors, clients and publishers) wishing to use the commissioned photography must be directed to the photographer. Connected parties may split a commission, this can help significantly reduce the cost per client. Joint commissions must be agreed before the shoot.
How will this be priced between third parties?
This can be useful for any contractors that have worked with the client on the project being photographed. This allows everyone access to use the images for their own marketing needs, at a reduced final cost to each party.
A split commission can be put in place, which will increase the total invoice cost 30% for each additional party added.
All parties included in the arrangement can then split the final invoice The main client will be billed for the total invoice and can arrange how they wish to split the costs directly with the other parties.
If the main client has already paid in full and a third party requests image licensing, then no discount will be available for the third party.
If a client was to commission me for a full day shoot, and had 3 other contractors that would also like to use the images (e.g. developers / construction engineers / interior designers/ lighting suppliers etc), the final breakdown for the job would be as follows:
£700 full day rate
+
£630 (£210 which is equal to 30% of the full day rate x 3 other contractors)
=
£1330
Divided by 4 parties involved in total including main client = £333 each party (rounded up)
Please note - The main client has full control over artistic direction and any requirements for the shoot. An independent commission will need to be set up by a third party if any requirements differ.
Rights
Reproduction rights are not automatically given to the commissioning client. Photographs in any format must not be sold, given or loaned to any third party. Appropriate reproduction fees will be charged to all third parties.
